DALLAS - The high courtroom will enable a wrongful demise lawsuit to proceed against the town of Dallas and 4 cops.

The household of a man who died in police custody in 2016 sued.

Tony Timpa called police for help as he had a drug and mental well being crisis.

The city fought against releasing physique camera video and whit it did come out it was apparent why. It showed the officers mocking the dying man.

One had his knee on Timpa’s back and neck for almost 15 minutes and the health worker said that contributed to his death.

The town of Dallas argued the officers are legally shielded from lawsuits.

The Supreme Court upheld a federal appeals court docket’s ruling that will allow the case to proceed.

"The choice implies that the case can proceed to trial and that there can be no extra delays from any appellate courtroom. Additionally, the decision signifies that the Fifth Circuit did it proper that their ruling concerning deadly force would be the regulation of the land at least in Mississippi, Texas and Louisiana for as long as we know," said Geoff Henley, an lawyer for Timpa’s family.

These are the states lined by the Fifth Circuit Court docket of Appeals ruling allowing the suit to continue.

Three years in the past, the Dallas district lawyer dropped criminal prices against three of the officers.
